
Under the Immigration and Refugee Protection Act, a person in need of protection is a person in
Canada who would be subjected personally to a danger of torture, a risk to their life, or a risk of
cruel and unusual treatment or punishment if they were returned to their home country.
Once an individual has been determined to be eligible to make a claim in Canada, as a refugee
claimant, you will have access to social assistance, education, health services, emergency housing
and legal aid while a decision is pending on your claim.
If your refugee claim has merit and falls within the convention grounds for refugee protection,

- Prepare your Basis of Claim (BOC) and related forms that must be sent to the Refugee
Protection Division of the Immigration and Refugee Board (IRB) to claim refugee status. You
will provide information about yourself, your family, and why you are claiming refugee
protection in Canada. - Representations at your Refugee Protection Division (RPD) hearing. This is a special court where
you need to go once you have sent in your BOC and explain why you are claiming refugee status.
You must establish a well-founded fear of persecution based on either race, religion,
political opinion, nationality, or membership in a particular social group.
