BREACH OF CONTRACT

A breach of contract occurs when one party who entered into a contract fails to do or perform the duties required under the agreement. If you are the wronged party, you or your company have a right to seek compensation or, in some special circumstances, specific performance to fulfill the obligations in the agreement.

Breach of contract disputes centre on the interpretation of the agreement and the relevant legislation and regulations at issue. We can assist you with legal representation in this regard.

We also handle real estate litigation matters that involve breach of contract, breach of warranty, buyer/seller misrepresentations, failure to close real estate transactions, as well as deposit and delay claims.

BREACH OF CHARTER OF RIGHTS AND FREEDOMS

Canada’s Charter of Rights and Freedoms provides guarantees that governments will respect the most cherished and fundamental rights and freedoms of Canadians.

  • right to free expression
  • right to equality
  • right to be secure against unreasonable search

We can assist you in putting legal representations in enforcing these rights, including the right to equality, fundamental freedoms such as the right to free expression, conscience and association, minority language rights, and guarantees such as the right to be secure against unreasonable search, seizure, or arbitrary detention. We provide advice and representation in bringing applications challenging the constitutionality of a law or government action; provide legal opinions on the constitutionality of laws, regulations, policies, or government action.

HUMAN RIGHTS

Human rights are an increasingly complex component of legal relationships in Canada. Human rights laws prohibit discrimination and harassment based on certain characteristics in areas such as employment, services, housing, and vocational associations. We litigate issues relating to the prohibited grounds of discrimination including race, colour, ancestry, religion, place of origin, ethnic origin, citizenship, sex (including pregnancy, gender identity), sexual orientation, sexual identity and expression, age, marital status, family status, disability, receipt of public assistance, and related grounds.

The limit remains $35,000 regardless of the number of people being sued. We provide legal representation to parties whose claim falls within the jurisdiction of the small claims court.
